These Terms & Conditions (“Terms”) govern the provision of follow-up services (“Service”) by Not Forgotten Co. Pty Ltd (ACN 689 926 707, ABN 93 689 926 707, Business Name: Not Forgotten Systems) (“we”, “our”, “us”) to our clients (“you”, “your”). By using our Service, you agree to these Terms.
1. Scope of Service
- Not Forgotten Systems provides follow-up communication services on behalf of businesses.
- This includes sending follow-up emails, SMS messages, or calls to your customers regarding quotes, jobs, or other agreed matters.
- We do not guarantee that follow-ups will result in sales or customer engagement — our role is to send and track follow-up messages only.
2. Client Responsibilities
- You must ensure you have obtained valid consent from your customers to be contacted before providing their details to us.
- You are responsible for the accuracy of customer information you provide.
- You must not provide any customer data that you are not legally entitled to share.
3. Privacy & Data Handling
- We handle all personal data in accordance with our Privacy Policy (available at www.notforgotten.com.au/privacy).
- We only use customer data for the purpose of follow-up communications and delete it after the follow-up process or within 90 days.
- You may request deletion of your data at any time.
4. Fees & Payment
- Service is billed on a subscription basis (monthly or annually) as agreed in your service plan.
- Payments must be made in advance via the payment method we provide.
- Late or failed payments may result in suspension or termination of service.
5. Cancellations & Refunds
- You may cancel your subscription at any time by providing written notice.
- No refunds are provided for partial months of service.
- We reserve the right to cancel or refuse service if you breach these Terms or provide false/misleading information.
6. Limitations of Liability
While we take care to perform our services accurately, we are not liable for:
- Loss of sales, revenue, or business opportunities.
- Errors or delays caused by incorrect customer data provided by you.
- Issues caused by third-party platforms (e.g. email or SMS providers).
Our total liability is limited to the amount you paid for the Service in the previous 3 months.
7. Acceptable Use
- You must not request that we send any content that is unlawful, defamatory, harassing, or otherwise inappropriate.
- We may refuse to send content that we reasonably believe breaches these rules.
8. Service Availability
- We aim to provide uninterrupted service, but we do not guarantee continuous availability.
- We may temporarily suspend the Service for maintenance, upgrades, or unforeseen issues.
9. Changes to These Terms
We may update these Terms from time to time. Changes will be effective once posted on our website or sent to you by email.
10. Governing Law
These Terms are governed by the laws of South Australia, Australia, and any disputes will be subject to the jurisdiction of South Australian courts.
